📜 ReplyBites Terms of Service

1. The Agreement 🤝

By using ReplyBites (the “Service”), you are agreeing to these Terms of Service. If you do not agree to these Terms, please do not use the Service.

2. Eligibility and Accounts ✅

  • Eligibility: You must be legally able to form a binding contract and must fully comply with all Instagram and Meta Platform Policies.
  • Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Use of the Service 🛠️

3.1. Authorization

You expressly authorize ReplyBites to use the Instagram Graph APIs to:

  • Fetch comments from your posts.
  • Send public replies and private replies (DMs) on your behalf.

3.2. Requirements

To use the service, you must ensure your Instagram account is:

  • A Professional Account (Creator or Business).
  • Linked to a Facebook Page.
  • Configured with “Allow Access to Messages” enabled.

3.3. Prohibited Use

You agree not to use the Service to:

  • Send unsolicited messages (spam).
  • Harass, abuse, or engage in unlawful behavior.
  • Violate any applicable laws or third-party rights.

4. AI and Content Responsibility 🧠

You are ultimately responsible for content published on your behalf.

  • Accuracy: AI outputs may sometimes be inaccurate, misleading, or inappropriate.
  • Review & Compliance: You are responsible for reviewing and approving any content you post or automate, and ensuring it complies with your brand guidelines, the Instagram Community Guidelines, and all relevant laws.

5. Plans, Billing, and Limits 💰

If paid plans are offered:

  • Details regarding fees, usage limits, and overage rules will be presented within the application.
  • Failure to make timely payments may result in the suspension or termination of your access to the Service.

6. Privacy 🔒

Your use of ReplyBites is also governed by our dedicated Privacy Policy.

7. Intellectual Property (IP) 💡

  • Our IP: We retain all rights, title, and interest in the Service itself (the code, design, and structure).
  • Your IP: You retain all rights in the content you create and process through the Service.
  • License Grant: You grant us a limited, necessary license to process and use your content solely to operate and provide the Service to you.

8. Termination 🛑

  • By You: You may stop using and terminate your account at any time.
  • By Us: We may suspend or terminate your access immediately if you violate these Terms or to comply with legal requirements.

9. Disclaimers and Limitation of Liability ⚖️

9.1. Service Provided "AS IS"

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind.

9.2. Limitation of Liability

To the maximum extent permitted by law, we disclaim all warranties and limit our liability. We will not be liable for any indirect, incidental, punitive, or consequential damages (including lost profits) arising from your use of the Service.

10. Indemnity 🛡️

You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, and expenses (including attorney's fees) arising out of your misuse of the Service or your violation of these Terms.

11. Changes to Terms 🔄

We reserve the right to update these Terms. For material changes, we will provide reasonable notification in advance. Continued use after the changes constitutes acceptance.
